Man Pleads No Contest to Trespassing, ICE Makes Arrest Shortly After
Last month, Jose Roblero Hernandez Perez, 21, was transferred from the custody of the Alachua County Jail to U.S. Immigration and Customs Enforcement (ICE).
Gainesville Police Department officers arrested Hernandez Perez in August on a count of attempted burglary. On October 21, he pleaded no contest to a lesser included misdemeanor offense of trespassing in exchange for a time-served sentence.
When speaking to Ofc. Larry Prunty, the victim indicated that she and her child got out of an Uber and entered their home. The victim said she heard someone honking their vehicle horn and initially thought it was the Uber driver, but she observed a man later identified as Hernandez Perez.
The victim reportedly said that Hernandez Perez asked her, “Do you work?” She told police she believed he was referring to prostitution. The victim said she closed the door when Hernandez Perez attempted to open it. He did not enter the home. The victim said she was afraid due to her daughter being inside the residence.
Prunty reported that Hernandez Perez was found hiding in bushes.
After being advised of his Miranda rights, Hernandez Perez indicated that the victim claimed to be a sex worker and offered to engage in sexual acts with him in exchange for money. He reportedly told police the victim snatched $50 from him and shut the door, leading him to attempt to open the door by twisting the knob.
Hernandez Perez said he hid from police because he was afraid they were immigration enforcement.
There was a witness who made statements consistent with the victim’s statements. The police report suggests that the victim and witness knew each other well enough for the witness to be a guest at the victim’s house.

Police read both the victim and witness a Miranda warning, and they both denied taking money or offering sex.
“I was not able to identify [Hernandez Perez], in reference to [him] being an illegal immigrant from Mexico,” reported Prunty.
As of October 27, Hernandez Perez was in ICE custody at the Baker County facility.

As of today, November 7, it appears that Hernandez Perez has been transferred to the Louisiana ICE Processing Center.
