Gainesville Man Convicted of Domestic Battery by Strangulation; Will Spend Five Months in Jail

Correction | Dec 5, 2025: It was reported that Davis would spend prison time when it was a jail sentence, and the wording of "found guilty" was changed to "conviction," as the former implies a jury found him guilty when he took a plea out of his own volition.


Xavier DeVante Davis, 32, was convicted of domestic battery by strangulation yesterday after pleading no contest on a plea deal.  

Judge David Kreider sentenced Davis to six months in jail, but with 37 days of time served, meaning Davis will spend roughly five months.

Davis was facing up to five years in prison before taking the plea deal. 

Davis will not be on probation when he is released. 

Davis choked the victim because he was mad about her hanging out with a male friend. Davis put the victim in fear of losing her life.
