Gainesville Man Convicted of Domestic Battery by Strangulation; Will Spend Five Months in Jail

Xavier DeVante Davis, 32, was convicted of domestic battery by strangulation yesterday after pleading no contest on a plea deal.  The case was resolved through a plea agreement.

Judge David Kreider accepted the plea deal, sentencing Davis to six months in jail, but with 37 days of time served, meaning he will spend roughly five months incarcerated.

Davis was facing up to five years in prison before taking the plea deal. 

Davis will not be on probation after he is released.

Davis choked the victim because he was mad about her hanging out with a male friend. Davis put the victim in fear of losing her life.

Correction | Dec 5, 2025: It was reported that Davis would spend prison time when it was a jail sentence.
