Man Arrested for Battery on Security Guard and Domestic Battery

Gainesville Police Department officers arrested Jose Tobias Vigil, 57, last week and charged him with aggravated domestic battery and battery on a security guard for two separate incidents. 

Vigil was asked to leave a bank by a security guard due to acting irritable towards the banker, according to the arrest report. Multiple witnesses told police that Vigil told the security guard they could “go outside” and “do something” before smacking him. 

In another incident, Vigil reportedly threatened his family member with a knife. The arrest report states, "At the time of the threat there was a black knife on the counter. [Vigil] then acted as if he was going to stab the victim in the throat with his hands. The victim no longer saw the knife on the counter when [Vigil] made a stabbing motion towards her neck. The victim stated she could feel [Vigil's] hand against her throat. The victim then ran away from [Vigil] to her son's room where she was again threatened... This time [Vigil] stated he would kill both her and their son who lives in the home. [Vigil] and the son then begin to engage in a physical altercation. Both the victim and 'son tell [Vigil] to leave which [he] refuses. The victim tells[Vigil] she is calling the police and [he] flees the home where he is later apprehended."

The victim told police Vigil’s “mental state has been declining since they moved to Florida from Colorado and each incident keeps getting worse.”

Vigil has no bond pending a pretrial detention motion by the State Attorney’s Office. 

It's unclear which incident occurred first. The pretrial detention motion states the incident between Vigil and the security guard happened shortly after the domestic battery incident. However, the arrest reports state the security guard incident happened three days before the domestic battery incident.
