Man Avoids Conviction in Felony Digital Voyeurism Case

On October 21, Sean Austin Cunningham, 28, was sentenced to a year of probation following a no contest plea in his felony digital voyeurism case.

Facing up to five years in prison, Cunningham took a plea deal that was accepted by Judge David Kreider, in which he was granted a withheld adjudication.

Cunningham was arrested in June and released on a $25,000 bond soon after. According to the arrest report, Cunningham “placed his cell phone in the bedroom of the victim to secretly record without her knowledge and consent. [Cunningham] recorded the victim who was dressing and privately exposing [her] body at a place and time when [she] had a reasonable expectation of privacy.”

The arrest report says Cunningham committed the crime for his own “sexual arousal and gratification.”
