Warrant Served Months After Domestic Violence Report on Gainesville Man

Brian Joseph Fischbach, 43, has been arrested on a warrant for false imprisonment and domestic battery by strangulation.
Fischbach was charged via sworn complaint on October 28, 2024, but a warrant wouldn’t be issued until March 28, 2025 and not served until Thursday.
The sworn complaint states the victim and Fischbach were arguing about the status of their relationship. When the victim tried to disengage by getting ready for bed, Fischbach reportedly grabbed her and held her down on the ground with his hand covering her mouth.
The victim was able to free herself and ran away, and Fischbach reportedly started chasing her around the residence and stopped her from leaving.
Fischbach reportedly grabbed the victim’s arm, snatched her phone out of her hands and threw it away from her.
The victim was able to escape the residence and ran to a nearby business to contact the police.
Gainesville Police Department Officer Dustin Johnson reported that the victim had a scratch on her bicep and another scratch on her chin.
Johnson reported, “I attempted to make contact with [Fischbach] at the residence and by phone, but I was unsuccessful in reaching him.”
Court records show Fischbach has another charge for robbery by sudden snatching, but it doesn't appear on his warrant or first appearance order.
Fischbach’s bond is set at $100,000.
In 2019, Fischbach was charged with domestic battery, false imprisonment, and obstructing justice, but the case was dropped due to insufficient evidence. The arrest report describes a similar incident to Fischbach’s current case.
