Man Arrested for Battery After Being Previously Granted Pretrial Diversion in Battery Case

On Saturday, Gainesville Police Department officers arrested Zachariah David Lower, 27, and charged him with simple battery (dating violence).

The arrest report states Lower head butted the victim during an argument. 

Officer Dante Zanders observed physical injuries on the victim. Lower denied attacking her.

Judge Phillip Pena set Lower's bond at $2,500.

In 2023, Lower was granted a pretrial diversion in a battery case where he injured the victim’s face. This means prosecutors with the Eighth Judicial Circuit State Attorney's Office agreed to close the case without an adjudication of guilt as long as Lower abided by certain conditions.
