Sheriff’s Office Deputy Did Not Read UF Vet Voyeur Miranda Rights Before Questioning

On July 8, former University of Florida Veterinary School Class Communications Co-Chair and alleged voyeur Gustavo Alejandro Zamora-Vazquez, was granted an evidence suppression motion.
Court records show that Deputy Orey Swilley questioned Zamora-Vazquez about filming the victim, leading him to confess. However, Swilley did not read Zamora-Vazquez his Miranda rights before the admission, prompting Chief Judge William Davis to order that his confession not be considered evidence in the case.
Body camera footage obtained by GnvInfo corroborates the court order, showing that Swilley detained and questioned Zamora-Vazquez without reading him his Miranda rights.
Zamora-Vazquez was not read his Miranda Rights until Swilley’s partner interviewed him.
The Alachua County Sheriff's Office (ACSO) Records Department redacted Zamora-Vazquez’s admission and post-Miranda statements on the body camera footage.
ACSO Records redacted the victim’s face and statements on one portion of the footage; however, another portion they released includes her statements and face without redaction. Footage involving the victim was cut in the video released by GnvInfo.
When deputies approached the victim, she was visibly shaken and said, “I was in my room naked, and there was a man filming me.”
The victim said she couldn’t identify the perpetrator except that he was wearing a short-sleeved shirt, which she noticed when she saw his wrist as he held up a phone to record her.
Zamora-Vazquez was wearing a short-sleeved shirt, the body camera shows, and deputies found two videos of the victim on his phone, according to court records.

Furthermore, the body camera footage shows that Swilley found footprints near the victim’s window that matched the shoes of Zamora-Vazquez.
While Deputy Ethan Miller arrested Zamora-Vazquez, Swilley told him that if he resists, he’s “going to jail with a dog bite.”
Zamora-Vazquez is currently pleading not guilty, but he has a plea change hearing scheduled for Wednesday, 9 a.m., at the Alachua County Criminal Courthouse in room 3-A.
